Golden's Gun Grab

What's Good For The [Golden] Goose Isn't Good For The [Unwashed] Gander.

To all my fellow gun-loving, right-wingers out there, I pose this question: Does/Did State Senator Marty Golden (R?-C?-I?) agree with Governor Andrew Cuomo’s ridiculous view that guns are only for hunting and “No one needs 10 bullets to kill a deer?"

The NY S.A.F.E Act (New York Secure Ammunition and Firearms Enforcement Act of 2013) was rushed through the legislature and signed by the governor less than a week after that speech.

Brooklyn's own "true champion of the Second Amendment" voted to make a law that:

1) made law-abiding citizens criminals for possessing magazines that could hold more than 7 bullets, including police officers! Keep in mind that no company makes 7-round magazines. You would think a former cop would know better.

2) did not specifically exempt current/active law enforcement officers which theoretically made every cop you see a criminal as well. Again, isn’t Marty Golden a former cop?

3) broadens the definition of assault weapons to include semi-automatic pistols and rifles with detachable magazines and one military-style feature, and semi-automatic shotguns with one military-style feature.

To make matters worse, Golden, after taking away our Second Amendment Rights, advocated to allow retired law enforcement officers - like him -  an exemption from this ludicrous 7-round limit imposed on the rest of us,

He said on the floor of the State Senate that night, after 2 AM:
They're not a separate class of people, ladies and gentlemen, but they are an experience[d] class of people.... They know how to deal with the criminal element, so if anybody deserves to have a 10-round magazine it is them.  (Emphasis added.)
What a crock! Not only did Marty push this to pass after midnight (like a thief in the night?) but don't we all have a right to defend ourselves and our families from the criminal element?

Speaking of Golden's police background, did you know that the NY S.A.F.E. Act criminalizes the failure to safeguard a firearm and/or not reporting a loss or theft within 24 hours of discovering said loss or theft?  Flashback a few decades:  Once upon a time, Officer Marty lost his own duty revolver! Senator Golden has since told several versions of the story involving the loss of his duty revolver which occurred in 1978.

See for yourself:

It's always in the last place you think to look...
I know I feel much SAFER knowing he can still carry a gun with more than 7 bullets!  He is so much more responsible with his weapon than the average shlub, right?

And what are “military-style” features? The NY S.A.F.E. Act includes such "dangerous" features as bayonet mounts, pistol grips on rifles, and the ability to accept a detachable magazine -  none of which make a gun any more dangerous.  Yet, law-abiding citizens can be arrested for using guns if they do not first check if the gun they already own complies with Golden’s bill.  In short, Senator Golden supported a bill that bans guns that have cosmetic features to make them look more like military weapons but do not add any lethality to the firearm.

All Golden did was make all New Yorkers less SAFE.  But so long as he isn't affected, then so what?

At the end of the day Senator Golden gave Andrew Cuomo and the Democrats a victory against the Second Amendment and helped him grab some press and momentum going into the 2014 gubernatorial cycle and the 2016 presidential election cycle.  While Democrats may love them for it, I suspect that Republicans who will be voting in an anticipated Primary Election in the 22nd Senate District in 2014 do not.

And to answer my original question:  Hey Marty - No one's ever been robbed by a deer in Brooklyn!

So the Senator claims that retired cops should be exempted from the law because they have the "experience to use it and to use it the right way". Besides the fact that the law is unconstitutional, what the Senator is saying is that former cops should be exempted since only they know how to properly use guns.

So I am to believe that a retired cop of 20, 30, 40 years is better equipped to own a 10 round magazine than.... an instructor at a shooting range? an active duty Soldier? a regular Joe Schmo who uses a gun for hunting every season and practices at ranges in the off-season? How ridiculous.

C'mon Marty.... Just say what you really meant. You wanted retired cops to be exempt from the law because you feel you are above the law.

  2. Great job Gallo!

Everyone should go to that OpenLeg link above Marty's quote and look at what Senator Ball said after Sen. Golden explained his shameful "yes" vote. That is a REAL (c)onservative, not a CON-man.

SENATOR BALL: There was a better way to do the SAFE Act. And congratulations to the Governor for dividing this conference. And you're going to have this conference be ripped apart. There be should be a lot of smiles over there. There was a better way to handle this from the very beginning. I'm deeply disappointed.

Now that I think about it, Senator Ball's quote may be a running theme when discussing Senator Golden - There was a better way to handle (fill in the blank).

  3. Here's an idea for a post... how is it hat the Con-servative Party Chairman (Gerard Kassar) earns more from the NY State Senate than his boss Marty Golden?

    Pay to play?

  4. On the last day of 2013, a Federal Court Judge struck down parts of the New York State Secure Ammunition Firearm Act of 2013 (NYS S.A.F.E. Act), including the seven-round ammunition limitation. Nonetheless, the Court upheld the law as a whole; deciding that, for the most part, it withstood constitutional scrutiny. In response, President of the New York State Rifle & Pistol Association Thomas H. King, first-named plaintiff in a federal lawsuit that questioned the constitutionality of New York’s anti-gun SAFE Act said, “[The] Western district court in Buffalo was the first step on the way to the U.S. Supreme Court.... While this was not a total victory it was not a total loss.” (See “New York Gun Owners Defiant...” in “Human Events/ GUNS & PATRIOTS” by Raquel Okyay, 1/3/2014 [http://www.humanevents.com/2014/01/03/n-y-gun-owners-defiant-despite-court-setback-safe-act-challenge-goes-on/]).

Even though there are many items in the decision with which disagrees, the President of NYSRPA said he is extremely happy with parts of the decision.

NYSRPA is the state’s largest and the nation’s oldest firearms advocacy organization.

GOLDEN COMPLETELY BEHIND TEAMSTERS BILL WHEN EVEN GOV. CUOMO BALKS

One of the big labor and crony-capitalist things that the faux “conservative” Brooklyn State Senator Golden supported and repeatedly voted for was something called the "New York State Commercial Goods Transportation Industry Fair Play Act" (S4589-2013). This bill was sponsored by the biggest pro-labor Democrat in the State Senate, Diane Savino, and it was passed with “bi-partisan support” over only minimal GOP opposition.

The Commercial Goods Transportation Industry Fair Play Act had been the subject of considerable lobbying in Albany by the Teamsters Union, which wants to organize many of the truck drivers in New York, by transportation industry associations, and by specific companies, such as FedEx Ground, which use independent contractors to deliver commercial goods to customers. Much of the lobbying was reportedly over certain of the prongs listed in the original version of the bill defining a separate business entity.

According to an article in the New York Post on Thursday by Josh Kosman, this “Act” is so dicey that Governor Cuomo has repeatedly delayed signing it (/twitter.com/joshkosman/status/418709087115677696; “Cuomo Punts on Labor Scrap” by Josh Kosman; http://nypost.com/2014/01/02/cuomo-punts-on-labor-scrap/). Among other things, this Act specifically favors FedEx over UPS.

IS MARTY GOLDEN REALLY AN IDC DEMOCRAT IN DISGUISE?

IF YOU SAW HIM AT DI BLASIO’S GRACIE MANSION BREAKFAST WITH IDC SENATE CO-LEADER JEFFREY KLEIN, YOU JUST MIGHT THINK SO

DI BLASIO ISN’T THE ONLY 2013 DEMOCRATIC WINNER THAT GOLDEN IS GETTING COZY WITH — GUESS WHO ELSE

Everybody knows about Mayor diBlasio’s “open house” at Gracie Mansion yesterday afternoon. Far less is known about diBlasio’s insiders “Thank You” breakfast at Gracie Mansion that was held much earlier on Sunday morning. Guess who was there. Well, of course there were lots of people there, mostly those associated with the Mayor’s Inaugural Committee. However, there was one real standout — the lone Republican officeholder in the room — now, can you guess?

The audience survey says: “ MARTY GOLDEN — DING - DING - DING - DING - DING!!!!”

AND, the Brooklyn Republican-Conservative state senator was in the house with Jeffrey Klein, the Bronx Democrat Chairman of the IDC and Co-leader of the NYS Senate.

This brings up so many luscious questions for “OUR GUY” Marty. Just what was he doing with Jeff Klein at a “thank you breakfast” being thrown at Gracie Mansion by Mayor Bill diBlasio? Wasn’t Golden a key guy for the GOP-Conservative candidate for mayor in the recent election, Joe Lhota? What’s up with all that?

Maybe, it just is that Golden already signed on to the tax hikes necessary to pay for diBlasio’s signature Pre-K program. After all, the NY Post today put its Gracie Mansion open house story on the same page as a story about State Senator Klein’s support for the diBlasio Pre-K proposal — and that usually is not an accident, especially when the same reporter has her by-line on both stories. No mention of State Senator Golden though, that’s probably because his participation in all of the Gracie Mansion goings on was strictly “off the record.”

That might not be the only double-dealing game by Marty coming out of the 2013 election disaster for the GOP and the Conservatives. This one is a shocker, too. Who would be the last person that you would think would be sending lists of recommended job-seekers to the new Democratic DA of Brooklyn, Ken Thompson — with a real expectation that the lists would be favorably acted upon? I know this is a tough one too. "Okay, so let’s take Charles “Joe” Hynes and Mike Long out of the possible people doing such an unlikely thing. AND give you a hint that he was reported to have been a key man in the Hynes’ race for DA as a Republican-Conservative in 2013.

The audience survey says: “ MARTY GOLDEN — DING - DING - DING - DING - DING!!!!”

That’s right GOP-Conservative State Senator Marty Golden is sending his picks to work in Thompson’s DA office to the Thompson people, AND he expects that they will be given the blue ribbon treatment. Now, why would somebody who was so strong for Hynes in November 2013 think that?

Say it ain’t so, Marty, say it ain’t so.

STATE SENATOR MARTY GOLDEN JUST DOESN’T SOUND LIKE A SOLID REPUBLICAN-CONSERVATIVE IN HIS OFFICIALLY PUBLISHED REACTION TO GOVERNOR CUOMO’S STATE OF THE STATE ADDRESS

GOP STATE SENATE CO-LEADER SKELOS IS JUST AS BAD

Repeatedly using phrases like “I very much look forward to working with Governor Cuomo” for a vitual laundry list of proposals State Senator Golden didn’t mention how any of it would be funded or that there might be any fight or opposition coming from him or the rest of the state senate Republicans.

The toughest thing Golden said, almost as an afterthought, was this: “Undoubtedly, there are areas that will require serious negotiations, in order to find common ground among the Governor, Senate and Assembly, but it is in the best interest of the taxpayers to have a productive session that reaffirms that New York is a great place to live, work and raise a family.”

The leader of the Senate Republicans and Co-leader of the State Senate, Dean G. Skelos, also got in on the lovey-dovey act. He almost sounded delusional by focusing only on Mr. Cuomo’s mention of cutting taxes, even going so far as to say that Governor Cuomo sounded like “a good moderate Republican.”

Although Mr. Cuomo’s speech occasionally did sound like a pro-business presentation, neither Golden nor Skelos mentioned that the Governor was also quite passionate when he said he would push hard for several very un-Republican issues. Abortion rights, campaign finance and Cuomo's version of ethics reforms, all of which were major elements of the debate during the 2013 legislative session will be brought up again with the strong support of the IDC Co-leader in the State Senate Jeff Klein. Bills on those issues were unsuccessful in 2013, but it is far from clear that they would not pass this year with at least some Republican support. Cuomo specifically said that he would try again on all those items in 2014, urging legislators to “stop playing politics with women’s rights” and promising success on new ethics laws that would include statewide campaign financing.

Everybody let slip by the fact that the Governor promised a huge expansion in public school costs across New York State with a promise of “Universal Pre-K,” but he failed to mention who would pay for it or how.

After the speech, Mayor Bill deBlasio, who needs legislative approval for his proposed “Rich Persons” City income tax increase to pay for Pre-K in New York City, praised the governor for presenting what he called “a progressive, proactive agenda for the future of our state,” and called the governor’s goal of expanding [Pre-K] statewide “a fantastic statement.”

If State Senator Golden and his local staff representative Anthony Testaverde were truly 'conservative' and 'Law and Order' Republicans, they should be all over the incidents of racial violence in and around the Kings Plaza Mall.

    So far not a peep!

Even Democrats like Fidler and Maisel have spoken out, and Councilman Maisel promised to follow up with both the cops and Kings Plaza management.

As State Senator Golden would say himself, “I KID YOU NOT!” In his own words on Facebook, Golden said that he is supporting Governor Andrew Cuomo not just one of Cuomo’s more acceptable proposals.

As it appeared at midnight 1/11/14 on Martin J. Golden’s Facebook:

“CERT 1 NYC, founded in the wake of the attacks of September 11th, is a perfect example of what Governor Andrew Cuomo visions [sic] with the New York State Citizen First Responder Corps announced at his 2014 State of the State address. I look forward to working with our Governor to better prepare for future storms and emergencies.”
    _______________________________

It looks like State Senator Martin J. Golden would rather support Governor Cuomo as if he were running with him in 2014, than dare look like he was only supporting one of the Governor’s better proposals. Note: Even if the proposal is a good one, which this one does seem like it might be, the state senator doesn’t say he supports the proposal that was presented by Cuomo, Golden clearly states that he supports Cuomo and Cuomo’s vision.

Oddly, Golden did get it right just a few hours before when he posted the following:

“Following today's meaningful hearing on the future of health care in New York State, I have serious concerns regarding the outlook of the system. The new implication of in-network vs. out-of-network doctors, along with the thousands of new patients, has rightly created apprehension about the ability of the current system to handle the expected increase.

People across this City and State, including myself, are worried that these changes will mean longer appointment, testing and surgical wait times, and about the overall effect on healthcare. We must make sure that the access, treatment and quality of care does not suffer during this transition.”

Doesn’t New York State Republican Chairman Ed Cox’ Letter ASKING CERTAIN REPUBLICANS NOT TO SUPPPORT GOVERNOR CUOMO Look Like It Was AIMED AT Brooklyn Republican State Senator MARTY GOLDEN ?
    __________________________

Even though a spokesman for GOP State Chairman Cox would not reveal which Republicans received the letter, an informed “guess” would have to conclude that backsliding Republican State Senators like Skelos and Golden were high on the list of addressees
    __________________________

The key points of the Cox letter are as follows: “When out of power, our job as a party is to provide loyal opposition, not for opposition’s sake but for the sake of the governing philosophy and principles that will advance our state.... The Cuomo administration is well known for their heavy-handed tactics in winning support, but for the sake of New York’s future, I hope I can count on Republicans such as yourself to be strong and to live up to our Republican convictions.” [‘New York GOP Asks Republicans Not to Endorse Andrew Cuomo” BY ROSS BARKAN – http://politicker.com/2014/01/new-york-gop-asks-republicans-not-to-endorse-andrew-cuomo/].

Cox continued with this plea: “I’m writing today because I know that the Cuomo administration is reaching out for your support. *** As State Party Chairman, I ask that before you make any decision, you consider the abysmal record of the Cuomo administration....*** After seven years and three Democratic Governors, New York remains the most taxed, most regulated, least economically free state in America with the highest outmigration and the most debt per capita, just as we were when Andrew Cuomo took office....”

Sad to say, based on things that State Senator Marty Golden has written and said, it is very clear that he, and his ilk in the GOP State Senate Conference, think that it is in their own best interest to say and do everything possible to show that they are on board with Democrat Governor Andrew Cuomo.

State Senator Golden re-posted Governor Cuomo’s letter about NY State assisted movies and the upcoming Oscars on Facebook and added this comment of his own:

“Martin J. Golden shared a link.

DOES MARTY GOLDEN BELIEVE THAT CONSERVATIVES NEED TO LEAVE NEW YORK LIKE ANDY CUOMO?

Marty Golden has had a lot of good things to say about New York Governor Andrew Cuomo lately. So much so that some conservative Republicans have even wondered if State Senator Golden might not be planning a jump to the Democrats in order to run on a ticket with Cuomo.
    _________________________

Now Governor Cuomo has put down a line in the sand for Republicans that might want to line up with him. According to Cuomo certain conservative Republicans have no place in New York with their right-wing views because "that's not what New Yorkers are." "Who are they?" Cuomo asked on Albany's The Capitol Pressroom radio show Friday.... Then the Governor sort of answered his own question — "Right-to-life, pro-assault weapons, anti-gay — if that's who they are, they have no place in the state of New York because that's not who New Yorkers are."
Cuomo then said his words didn't extend to moderate Republicans, such as those in the state Senate, who he said "have a place in their state." [ as reported in Newsmax by Sandy Fitzgerald — http://www.newsmax.com/Politics/andrew-cuomo-new-york-conservative-place/2014/01/18/id/547828; in the New York Post by Aaron Short — http://nypost.com/2014/01/18/gov-cuomo-to-conservatives-leave-ny/; and several other media sources].
    _________________________

How far does Marty Golden’s support of Andrew Cuomo really go? It seems clear that Cuomo is comfortable with Marty Golden and several of his “moderate Republican” colleagues in the New York State Senate.

Is Marty Golden in sinc with what Cuomo had to say about conservative Republicans?

Does Golden also believe that RTL, pro-gun, anti-gay marriage conservative Republicans have “NO PLACE IN THE STATE OF NEW YORK”?

Is Golden ready to stand up to the Governor and denounce these remarks for the closed minded bigotry that they do represent?

More than a week has passed since Cuomo slammed those he says are "Extremist conservatives" -- who are anti-abortion, pro-gun rights and anti-same-sex marriage.

A week ago, the question was asked above: "Is Golden ready to stand up to the Governor and denounce these remarks for the closed minded bigotry that they do represent?"

So far, it looks like Golden can't bring himself to do that. So far, not a peep from the Brooklyn GOP State Senator about Cuomo's left-wing ideological extremism; even now, after the NYS Governor has been joined in his outrageous remarks by NYC Mayor deBlasio ....

It looks as if Golden only can say nice things about these guys, even when they want to submit New York State to their brand of ideological cleansing. Since he's earned Cuomo's acceptance as a "moderate Republican," Golden doesn't want to risk losing it standing up for "extremist" right-to-lifers, 2nd Amendment advocates and those who want to preserve and protect the traditional family.

Did State Senator Golden Drop the Ball on Sandy Relief for his constituents ? Is he doing anything to fix what’s wrong with the Sandy rebuilding effort ?

Yesterday at a public hearing in Albany, State Senator Martin Golden virtually threw up his hands in complete surrender over his inability to get rebuilding money through to the residents of Gerritsen Beach, Manhattan Beach and Sheepshead Bay (See “STATE SENATOR MARTIN J. GOLDEN ASKS FOR UPDATE ON SANDY FOR LOCAL COMMUNITIES STILL SUFFERING” Posted by Martin J. Golden, 1/27/14, State Senator Golden’s Website [http://www.nysenate.gov/press-release/state-senator-martin-j-golden-asks-update-sandy-local-communities-still-suffering]).

Most people will see Golden’s most recent post as a routine and pointless press release that says and, more important, does nothing new about the massive problems that followed the Sandy superstorm, only some of which are described by State Senator Golden in the release. However, it is really much more than that — it is an admission of defeat and it is an admission of complicity in the screw ups that started long before Sandy, and which go on and on and on and on and on.....

Does Golden actually think that asking for updates and inviting people for a Cook’s Tour of Gerritsen Beach, Manhattan Beach and Sheepshead Bay is doing anything for the Sandy victims who live there and are waiting for help to rebuild ? Probably not, but he has to say something, doesn’t he. His mistake is that he said too much, he mentioned his January 13th letter to Mayor de Blasio.

Buried in State Senator Golden’s letter to the mayor is this:

“Their (the residents of Gerritsen Beach, Manhattan Beach and Sheepshead Bay) frustrations are exacerbated by their fellow New York State residents who are receiving thousands of dollars from NY Rising in order to rebuild and recover. The regular news of how NY Rising is moving forward and distributing money is exactly what I was hoping to avoid when we put together the separate for the city and the state. I want to see my constituents in NYC getting the same benefits as those across the state....” [From State Senator Golden’s 1/13/14 letter to Mayor de Blasio]. In spite of the fractured English usage in the letter, it is clear that something is very wrong — According to Marty Golden, New York State and federal money is going to Sandy victims outside of the city through the “NY Rising” program, but it isn’t being distributed to city residents who were Sandy victims through the “Build it Back” program.

In that letter, Golden virtually admits that money is not getting through to his constituents. He also says that he was worried that the separate programs, one for New York City and another for the rest of the state, would lead to different treatment for the constituents of his district. He didn’t do anything about it then; and he can’t seem up to doing anything about it now.

So guess what; there are New Yorkers outside Golden’s district getting money to rebuild while New Yorkers from Gerritsen Beach, Manhattan Beach and Sheepshead Bay are not. Golden knew about it, Golden knows about it and Golden isn’t doing anything about it.

Imagine New York State Senator Martin Golden standing up and calling for the recall of Wisconsin Governor Scott Walker — that would not be as far fetched as some of you might think.

Remember it was Wisconsin’s public employee unions that led both the Walker recall effort and the recall campaigns against several GOP state senators.

Against that backdrop as a comparison, take a look at Brooklyn Republican-Conservative State Senator Martin Golden’s Keynote Address at the Public Employees Conference held at the New York State Capitol. In his remarks earlier today to those gathered at the conference, Golden stated, “There can be no progress in this State at the expense of [public employee] jobs and without protecting [public employee] pensions and [public employee ] benefits. There can be no progress if it hurts the people who are truly the backbone of New York State services. Because [public employees] are the people who are some of the best educators of our children in the country. [Public employees] are the dedicated professionals who keep our streets safe, who keep our streets clean, and who have helped to make New York the greatest state in the country in which to live, work and raise a family.” (Golden’s remarks repeatedly used the word “you” which was addressed to the gathered public employees and their union leaders. I have substituted “public employee” and “public employees” that did not change the meaning or intent of the remarks one bit.)

That is exactly the kind of nonsense that was being peddled by Wisconsin’s public employees and their supporters who occupied Wisconsin’s capital to keep Republican lawmakers from passing laws that made minimal roll-backs to some of the benefits of Wisconsin’s public employees. Those laws did pass and Wisconsin’s local economy is surging, unlike what is happening here in New York State — largely thanks to people like Marty Golden.

Golden’s own press release stated the following: “Senator Golden encouraged the many unions represented to talk with legislators today in Albany on behalf of their members, expressing union goals for this legislative session. ‘Remind them of all the good work that you do,’ said Senator Golden.” – http://www.nysenate.gov/press-release/senator-golden-gives-keynote-address-public-employees-conference

The report of Marty Golden’s delivering the keynote address to the New York State Public Employee Conference’s “legislative event” at the New York State Capitol early this week is only his most recent report of Golden’s longstanding and ongoing intimate interaction with that particular labor association.

In December 2011, State Senator Martin Golden attended the New York State Public Employee Conference’s Annual Convention at the luxurious Caribe Hilton in San Juan, Puerto Rico along with as many as 300 public employee union bosses. And it was reported at the time by the New York Post that Golden, who sits on one of the key NY State Senate committees that oversee public-sector workers even held fund-raisers there. Golden’s fund raising gathering was attended by many of the same union officials who will later appear before Golden’s committee to plead their unions’ causes.

Who gets to plead to Golden’s committees on behalf of New York taxpayers or Golden’s constituents after these bosses of New York's public employee unions have had their say?
